Estate RecoveryThe Medicaid Estate Recovery program is based on a Federal law that requires states to recover money paid for Medicaid benefits from a Medicaid recipient’s estate after the recipient dies. Claims paid for all Medicaid services provided to persons 55 years or older are subject to recovery, but recovery from the estate may only be made: l After the death of the Medicaid recipient’s surviving spouse. l At the time when the recipient has no surviving child under the age of 21. l At a time when the Medicaid recipient has no surviving child of any age who is blind or disabled. l When recovery from the estate does not create an undue hardship.
